The Nazooza (Henceforth: The business) application (henceforth: app/s) only serves as an advertising platform for agents to attract their customers. The business has no responsibility of any kind over content provided by the advertisers (travel agents). The business does not verify the content or accuracy of statement/s made by advertisers and it is the sole responsibility of the user to verify any such statements.
1. General
1.1. The website is used as an electronic commerce site (virtual store), established and operates by NAZOOZA, referred to as “The Business” located at HADASOT 15 RAMAT HASHARON 1.2. The terms herein are in reference to the website and/or the associated application/s (apps). Whenever the term The Website is mentioned below, it includes the associated applications 1.3. The terms & conditions detailed in this document will govern usage of the services offered by The Website. Using The Website will act as an agreement to the terms & conditions detailed here verbatim and the terms & conditions detailed here will act as the basis for any legal discussion between the user and The Business. By using the website, the user admits to have read and agreed to the terms & conditions detailed here 1.4. The consumer is aware that the site is used as a reference tool only for the purpose and manner of purchasing tourism products 1.5. This document applies to all users of the site 1.6. The services offered by the website are offered on as-is basis and the business will bear no responsibility for accommodating the user’s needs or goals 2.3. The website connects between providers of travel/tourism services “Service Providers” who are willing providers and willing service consumers. The website is only offered as a platform to connect between the service providers and the consumers. The business and the website have no relation nor responsibility to the transaction between the service provider and the consumer, such transaction will be governed by the terms & conditions agreed upon between the service provider and the consumer 2.4. The site presents the consumer with a number of options for tourism products but the site cannot be held responsible for the products advertised on its platform as those are the sole responsibility of the advertiser 2.5. The prices shown on the site are provided to the business by the advertisers and the business has no control over those prices 2.6. The offers on the site are provided to the business by service providers/advertisers over which the business has no control. Information provided by the advertiser is the advertiser’s sole responsibility and the business shall have responsibility over the content, its accuracy including details regarding a third party and services offered by such third party, as well as prices and any other information advertised 2.7. The business cannot guarantee that the prices for offered by its advertisers will be the final cost charged to the consumer. Some products may sell for a lower or higher price than advertised on the site. The prices displayed are the prices determined by the advertiser and the business bears no responsibility, direct or indirect to the prices or any use of this information by the consumer 2.8. By using the website, the consumer is confirming awareness that the information displayed in advertiser’s ads matches the information provided to the business by the advertiser 2.12. The website may include links to external websites which are not related to or operated by the business. Those links are provided as a service to the user however the business is not responsible for the content of any externally linked websites. Including these links on the website does not express confirmation or an agreement with the content by the business. Any usage of said external links is the sole responsibility of the consumer 2.13. The business including its managers, employees or anyone employed by the business is not responsible for any damage direct or indirect caused to the consumer and/or any third party due to usage of information and or content provided by the advertiser. It is also agreed that the business will not be held responsible for any cancelation or interruption of services to the consumer including due to disruption in transmission of information by any third party regardless of whether its due to malintent or malfunction 2.14. Prices displayed on the website include VAT wherever it is required by law 2.15. The prices displayed on the site are not necessarily the lowest prices offered for those products and it is the responsibility of the consumer to research market prices 2.16. The variety of products offered on the site is at the sole discretion of the business 2.17. The business reserves the right to offer products for sale on the website in quantities, price and conditions under its sole discretion. The business reserves the right to add, subtract, control prices and quantities of any product it offers for sale as well as the terms of purchase 2.18. The site sometimes offers products under special pricing and it is the responsibility of the consumer to verify the details of any special pricing offer including its expiration. 3. Advertiser/Service Provider Eligibility
3.1. To be eligible to become a service provider applicant must be at least 18 years of age and poses all the following requirements; 3.1.1. Able to perform any required legal actions 3.1.2. Has a valid Israeli ID (Individual) or a legally registered business in Israel 3.1.3. Holder of a valid credit card issued by one of the Israeli credit card companies 3.1.4. Has an email and a valid physical address in Israel
4. Privacy Policy
4.1. At the time of registration to the website as well as at the time of performing a purchase the consumer will be asked for preferences relating the websites’ electronic communication preferences 4.2. The business respects the consumers’ privacy and offers the option to be removed from the mailing list both at the time of registration as well as in the electronic communication should the consumer initially elect to subscribe 4.3. Should the consumer subscribe to the mailing list, the consumer agrees to receive electronic communication regarding all types of sales the website offers as well as any other platform available on the website currently or in the future 4.4. 6. Termination of Service
6.1. The business reserves the right to either suspend or terminate a user’s account at its sole discretion and without prior notification 6.2. The service provider deemed to have intentionally provided false information 6.2.2. The service provider deemed to have acted or neglected to act in a manner which caused or may cause harm to the business or any third-party including customers of the business 6.2.3. The service provider deemed to have used the business platform to commit, enable, assist or encourage an illegal act 6.2.4. The service provider deemed to have violated the terms of this agreement or any other agreement with the business and or its representatives 6.2.5. The service provider failed to pay when required to do so by law for purchases from the business or the website
7. Legal Jurisdiction
The appropriate court in Tel Aviv – Yafo will have the ultimate and sole jurisdiction
8. Additional Terms
8.1. The business reserves the right to change these terms & conditions, amend, add or subtract any of the terms 8.2. By using the website, the service provider understands and agrees that the business cannot assure nor is responsible that the server/s on which the website is hosted is free of viruses and/or any other form of malware which can harm the service providers’ computer or any other associated equipment 8.3. It is understood and agreed that the images representing products are for illustration purposes only and the final product may look differently than the representative image presented on the site. It is also understood that the consumer cannot rely solely on the information provided on the site and should seek appropriate professional expert advice. In the case of a contradiction between an image and its verbal description, the verbal description supersedes the image 8.4.
